1. Scope
These Terms & Conditions govern your use of the Swaptape mobile application and related services (the "Service"), which are provided by MONORIFT s. r. o., Brezova 478/6, 044 20 Mala Ida, Slovakia ("MONORIFT", "we", "us", or "our").
By downloading, accessing, or using Swaptape, you agree to these Terms & Conditions. If you do not agree, do not use the Service.
2. About Swaptape
Swaptape is a private, invite-only voice sharing service built around shared group tapes. The Service allows users to create or join groups, upload voice recordings, add tape label artwork, react to moments, comment on tapes, and manage group and notification settings.
3. Eligibility and accounts
You must be legally able to enter into these terms in your jurisdiction in order to use the Service. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these terms.
- Provide accurate account information.
- Maintain the security of your device and account.
- Remain responsible for activity that occurs through your account, to the extent permitted by law.
Swaptape currently uses Sign in with Apple as a core sign-in method in the shipped app experience.
4. User content
You may submit content to the Service, including recordings, images for tape labels, comments, reactions, profile information, and similar materials ("User Content").
You retain ownership of your User Content, but you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, adapt, transmit, and display that User Content as necessary to operate, maintain, improve, and provide the Service for you and the groups you participate in.
You are responsible for User Content that you submit. You represent that:
- you have the rights and permissions needed to submit it;
- your User Content does not infringe intellectual property, privacy, publicity, or other rights;
- your User Content does not violate applicable law or these terms.
5. Acceptable use
You agree not to:
- use the Service for unlawful, harmful, fraudulent, deceptive, threatening, abusive, harassing, or defamatory conduct;
- upload or share content that infringes another person's rights or violates applicable law;
- attempt to gain unauthorized access to the Service, other accounts, or related systems;
- interfere with or disrupt the integrity, security, or operation of the Service;
- reverse engineer, decompile, or attempt to extract source code from the Service except where applicable law prohibits that restriction;
- use the Service to distribute malware, spam, or other harmful material.
We may remove content, suspend features, or restrict access if we reasonably believe conduct or content violates these terms, harms users, or creates legal or operational risk.
6. Groups, ownership, and account deletion
Some parts of the Service depend on group ownership and membership rules. If you own a group, you may need to transfer ownership or remove other members before deleting your account. We may refuse or delay account deletion until those ownership constraints are resolved.
You are responsible for how you share invite codes and for the people you invite into private groups.
7. Third-party services
The Service relies on third-party providers for certain functionality. Your use of those services may also be subject to their terms and policies. These providers may include:

- Cloudflare: Cloudflare Terms
We are not responsible for third-party services except as required by applicable law.
8. Privacy
Our collection and use of personal data is described in our Privacy Policy. By using the Service, you acknowledge that your information will be handled in accordance with that policy.
9. Availability and network access
Some features of the Service require internet access, compatible hardware or software, and ongoing service availability. We do not guarantee that the Service will always be available, uninterrupted, secure, or error-free.
You are responsible for any charges from your mobile carrier, internet provider, or device platform that result from your use of the Service.
10. Intellectual property
The Service, excluding your User Content, is owned by MONORIFT or its licensors and is protected by applicable intellectual property laws. We reserve all rights not expressly granted to you.
You may use the Service only as permitted by these terms and applicable law.
11. Updates, termination, and disclaimers
We may modify, suspend, or discontinue any part of the Service at any time, including features, functionality, or availability. We may also release updates that you need to install in order to continue using some or all of the Service.
You may stop using the Service at any time. We may suspend or terminate your access if we reasonably believe you have violated these terms, created risk for users or the Service, or if we are required to do so by law.
The Service is provided on an "AS IS" and "AS AVAILABLE" basis to the fullest extent permitted by law. To the fullest extent permitted by law, we disclaim warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, MONORIFT and its directors, officers, employees, contractors, affiliates, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or business opportunities arising out of or related to your use of the Service.
To the fullest extent permitted by law, our total liability for claims arising out of or relating to the Service will not exceed the greater of the amount you paid us for the Service during the 12 months before the claim arose or EUR 50.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.
13. Changes to these terms
We may update these Terms & Conditions from time to time. If we make material changes, we may update the effective date above and provide notice through the app, our website, or other appropriate means. Your continued use of the Service after the updated terms take effect means you accept the updated terms.
